On September 22, 2025, Region 3 filed a Consent Agreement and Final Order (CAFO), simultaneously commencing and concluding an administrative enforcement action against YOK, LLC, for the South Bridge, BP facility located in Wilmington, DE (the Facility ). The CAFO was issued for alleged violations of RCRA Subtitle I and the authorized Delaware Regulations Governing Underground Storage Tanks ( DRGUST ). The alleged violations include: 1) failure to report an unusual operating condition, 2) failure to investigate a suspected release, 3) failure to monitor tanks for a release at least every 30 days, and 4) failure to conduct periodic operation and maintenance walkthrough inspections at least every 30 days. This enforcement action furthers Administrator Zeldin's Pillar 1: Clean Air, Land, and Water for Every American. The EPA notified Delaware Department of Natural Resources ( DNREC ) in advance of this action, and DNREC had no objections. Per the terms of the Consent Agreement, YOK, LLC will pay a $50,672.00 civil penalty.
