Respondent failed to make a hazardous waste determination on one of its waste streams. This failure led to the potential disposal of hazardous waste into the municipal waste stream. Additionally, Respondent failed to transfer hazardous waste from containers in damaged condition to structurally intact containers. Lastly, Respondent failed to comply with several of the RCRA safe harbor provisions. Therefore, Respondent was operating as a transfer, storage, or disposal facility without a required permit.
