On September 29, 2025, EPA Region 1 entered into an Expedited Settlement Agreement ( ESA ) with RK Wing, Corp., d/b/a Rossini's Pizzeria & Restaurant ( RK Wing ), based in Concord, Massachusetts, resolving violations of Title II of the Clean Air Act ( CAA ), Sections 203(a)(1) and 213(d). The ESA alleged that engines imported by RK Wing displayed false engine emission labels, in violation of 40 C.F.R. Section 1068.101(b)(7)(iii), and did not bear accurate permanent labels as required by 40 C.F.R. Section 1039.135. Under the settlement, RK Wing has paid a penalty of $1,800 and taken corrective action with respect to the engines. EPA, through its direct implementation authority, plays a critical role in ensuring imported engines have legitimate emission information labels that verify the engines meet EPA standards in limiting harmful pollutants and air toxics. EPA worked with U.S. Customs and Border Protection on this matter.
