On September 17, 2025, the EPA finalized a Consent Agreement to resolve TSCA Lead-Based Paint Disclosure violations, under section 1018 of the Residential Lead-Based Paint
Hazard Reduction Act, with Clooten Property Management, Inc. (Clooten) of Bismarck, North Dakota. Clooten agreed to resolve the noncompliance and also pay a $11,300 penalty
for violations identified as the result of a June 5, 2024 subpoena. Clooten Property Management, Inc. failed to provide the required lead hazard information for at least 10 rental
properties.
