Summary

On September 30, 2025, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against James River Petroleum, Inc. for its Ashland Exxon Facility located at 105 S Carter Road, Ashland, Virginia, 23005 (the Facility ). The EPA alleges that Respondent 1) Failed to Inspect Impressed Current Systems Every 60 days; 2) Failed to Use Secondary Containment on Piping in Accordance with Applicable Regulations; 3) Failed to Properly Test or Inspect Overfill Prevention Equipment; 4) Failed to Use a Spill Prevention System; 5) Failed to Comply with Financial Responsibility Requirements and 6) Failed to Ensure that Cathodic Protection System is Tested Every 3 Years and 7) Failed to Operate and Maintain Corrosion Protection System Continuously in violation of RCRA Subtitle I and the authorized Virginia Underground Storage Tank Regulations. The EPA notified Virginia in advance of this action, and Virginia had no objections. Per the terms of the Consent Agreement, James River Petroleum, Inc. will pay a $106,441 civil penalty.
