On September 29, 2025, Region 3 filed a Consent Agreement and Final Order ( CAFO ) commencing and concluding an administrative enforcement action against Four Seasons Produce, Inc., a produce storage and distribution facility located in Ephrata, Pennsylvania (the Facility ). The CAFO was issued for alleged violations of Section 311 of the CWA and the implementing Oil Pollution Prevention Regulations at 40 CFR Part 112, including failure to prepare and implement a spill prevention, control, and countermeasure ( SPCC ) plan and failure to have adequate secondary containment at the Facility. The CAFO also resolves Respondent's alleged violations of Section 402 of the CWA for failure to comply with its National Pollutant Discharge Elimination System ( NPDES ) permit (Permit No. PA0247537) by failing to install best management practices to inlets; implement best management practices to clean up spills and leaks; and develop and implement a preparedness, prevention and contingency ( PPC ) plan. This enforcement action furthers Administrator Zeldin's Pillar 1: Clean Air, Land, and Water for Every American. EPA notified Pennsylvania's Department of Environmental Protection ( PADEP ) in advance of this action, and PADEP had no objections. Per the terms of the Consent Agreement, Four Seasons Produce will pay a penalty of $28,500.
