On September 30, 2025, the EPA, Region 3 entered into an Administrative Order on Consent ( Consent Order ) with Joe Darrah, Inc. d/b/a J & K Salvage ( J & K Salvage ) alleging violations of the CAA and the Pennsylvania SIP at its metal scrap shredder facility ( Facility ) located in York, Pennsylvania. The Facility began operating in 1999. Based on the company's responses to CAA 114 Information Requests, Region 3 determined that the Facility has the potential to emit at least 50 ton per year (TPY) of volatile organic compounds and is, therefore, a major stationary source under the CAA. On November 4, 2024 Region 3 sent J & K Salvage a Notice of Violation. The Consent Order requires J & K Salvage to comply with operational limitations to keep the Facility's VOC emissions below the 50 TPY limit while the company applies for a Synthetic Minor Operating Permit. The EPA notified Pennsylvania Department of Environmental Protection of the action. Taking action against such violations aligns with Pillar 1 of the Powering the Great American Comeback initiative as it addresses access to clean air, land, and water.
