Carmeuse Lime, Inc., Grand River, Ohio violated the National Emission Standards for Hazardous Air Pollutants for Lime Manufacturing Plants (the LMP NESHAP). Specifically, the LMP NESHAP requires Carmeuse to operate the stack for its lime kilns below 15% opacity, without malfunction exemptions, and to continuously monitor opacity. Carmeuse exceeded the 15 percent average opacity limit at its lime kiln stack for 7,938 minutes between April 3, 2020 and September 23, 2024. Carmeuse also failed to demonstrate compliance with the opacity limit by failing to collect continuous opacity monitoring system (COMS) data at its lime kiln stack for 14,592 minutes during May 1?15, 2020 and August 29?30, 2023. A concurrent ACO sets forth a compliance plan to ensure continuous compliance with the LMP NESHAP. This CAFO requires Carmeuse to pay a penalty of $98,750 and resolves the FOV issued to Carmeuse on December 31, 2024.
