On September 29, 2025, EPA Region 3 issued an Administrative Compliance Order on Consent (Order) to Strittmatter Materials, LLC (Strittmatter), the owner and operator of an electric powered crushing and screening plant located at 3334 Kenilworth Avenue in Hyattsville, Maryland ( Facility ). Based on information obtained as part of its investigation, EPA determined that, due to conduct of the Facility's previous owner in connection with the installation of a replacement secondary crusher in 2014, Respondent's permits do not reflect the appropriate provisions of the New Source Performance Standards for Nonmetallic Mineral Processing Plants, codified at 40 C.F.R. Part 60, Subpart OOO (NMPP NSPS) in violation of the NMPP NSPS and of Maryland state implementation plan (SIP) permit programs. The Order, to be issued under the authority of Section 113(a) of the CAA, requires Respondent to conduct one of two compliance options to either: (1) comply with, and submit applications to incorporate as enforceable permit provisions, the more stringent requirements of the NMPP NSPS applicable to affected facilities that commence construction after April 22, 2008; or (2) comply with the requirements of the NMPP NSPS applicable to affected facilities that commenced construction after August 31, 1983 but before April 22, 2008, and submit applications to incorporate throughput limits, monitoring, recordkeeping and inspection provisions as enforceable permit requirements to ensure the secondary
