On October 6, 2025, EPA issued a Consent Agreement and Final Order (CAFO) with penalty to the Sherwin-Williams paint manufacturing plant located in Garland, Texas. The CAFO addresses violations of the three criteria under the CAA General Duty Clause, Section 112(r)(1) for a fire and explosion that occurred on 08/07/2023: failure to identify hazards; failure to design and maintain a safe facility; and, failure to minimize the consequences of an accidental release that occurred. Although there were no fatalities and only one minor injury, the incident resulted in airborne chemical releases and adverse impact to an adjacent segment of Duck Creek from discharges of fire fighting water mixed with hazardous chemicals, plus total destruction of the affected process building. Other agencies that collaborated for the incident response included TCEQ, OSHA, and the City of Garland Fire Department. Sherwin-Williams has 45 calendar days from the CAFO effective date to pay the civil administrative penalty of $195,686.99.
