On October 9, 2025, Region 2 entered into an Administrative Settlement Agreement for Recovery of Response Costs (Settlement Agreement) with respect to the NL Industries Superfund Site. This Settlement Agreement was issued pursuant to Section 122(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (CERCLA), 42 U.S.C. 9622(h). The Settlement Agreement resolves the potential liability of the Settling Parties for $739,741.91 in past response costs paid in connection with EPA?s oversight of the Settling Parties' performance of the first operable unit remedial design and remedial action for the Site during the period from October 1, 2021, through September 30, 2024. On September 17, 2025, EPA issued a demand for $739,741.91 in past response costs. Under the Settlement Agreement, the Settling Parties paid the full amount of the demand.
