10/20/2025 - CONSENT AGREEMENT FINAL ORDER ISSUED ASSESSING A PENALTY OF $ 5,350.00 PENALTY DUE WITHIN 30 DAYS OF THIS CAFO.
Upon reviewing the entry documentation for Metamitron, including the labels on the product, the EPA observed that the pre-approved label and its required statement was not attached to the product upon entry into the United States as required by the Section 18 emergency exemption. Instead, an incorrect label was used, which contained the following statement. This product is being imported into the United States for the sole purpose of manufacturing, formulating, or repackaging into an EPA-registered pesticide product. Consequently, the label on the unregistered pesticide product, Metamitron, did not meet the express conditions and
requirements of the Section 18 emergency exemption.
The EPA alleges that Respondent violated Section 12(a)(1)(A) of FIFRA, 7 U.S.C. � 136j(a)(1)(A), by distributing the unregistered pesticide, Metamitron, on or around January 12, 2025, as outlined in this CAFO.
