On December 1, 2025, EPA Region 1 filed an administrative settlement with Guida-Seibert Dairy Company that resolves EPA's claims that Respondent violated the chemical accident prevention provisions of Section 112(r) of the Clean Air Act ( CAA ), 42 U.S.C. 7412(r), and the Risk Management Plan ( RMP ) regulations promulgated thereunder at 40 C.F.R. Part 68. EPA alleged violations related to the design and operation of the ammonia cooling system at the dairy processing facility in New Britain, Connecticut. Under the settlement, Respondent will pay a $104,221 penalty and certify that its facility is now in compliance with 40 C.F.R. Part 68. Complying with RMP regulations helps companies prevent accidental releases of extremely hazardous substances. Also, the RMP requirements help companies and emergency responders prepare for and respond to chemical emergencies. Connecticut is not delegated to implement the RMP regulations, but EPA shared the settlement with the State upon issuance.
