On December 15, 2025, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 309 of the Clean Water Act to Mountain Creek Power, LLC. (Mountain Creek Steam Electric Staton) WWTF. The AO was issued in response to effluent violations of permit limits. The AO requires the facility to 1.) submit a list of specific actions taken to correct the violations and 2.) submit written certification to EPA that the violations have been corrected, and the facility is compliant with its permit. The Respondent must respond to EPA Region 6 within thirty (30) days of the effective dated of the AO. Texas Commission on Environmental Quality (TCEQ) has primacy for this facility. Per the Memorandum of Agreement between TCEQ and EPA, TCEQ informed EPA that is would not be able to complete the enforcement action by the established time frame. TCEQ and EPA have consulted regarding EPA issuing this enforcement action.
