FIFRA NOW: 12/03/2025 Greenscapes Home & Garden Products Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) Case File No. FIFRA-04-2026-3503 The U.S. Environmental Protection Agency regulates the registration, distribution, sale and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. ?? 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Greenscapes Home & Garden Products (hereinafter Greenscapes), pursuant to Section 14(a)(4)] of FIFRA, 7 U.S.C. ? 136l(a)(4)], which provides the EPA with the authority to issue a NOW. As explained below, the EPA finds that Greenscapes violated FIFRA Section 12(a)(1)(F) by distributing or selling a misbranded pesticide device. Pursuant to Title 40 of the Code of Federal Regulations (C.F.R.). ? 156.10(a)(1)(v), every pesticide product shall bear a label containing the producing establishment number. Pursuant to Section 2(q)(1)(D) of FIFRA, 7 U.S.C. ? 136(q)(1)(D), a pesticide is ?misbranded? if its label does not bear the registration number assigned under Section 2 of FIFRA, 7 U.S.C. ? 136e, to each establishment in which it was produced. By not including an EPA Est. No. on the product label, the device is misbranded.
