Based on the facts set forth in in section IV of this Agreement, Respondent used two registered pesticides in a manner inconsistent with its label in violation of section 12(a)(2)(G) of FIFRA, 7 U.S.C. ? 136j(a)(2)(G) and is therefore subject to the assessment of civil penalties under section 14 of FIFRA, 7 U.S.C. ? 136l.
