The SMS RCRA ESA was filed on December 11, 2025 (Docket No: RCRA-09-2026-0015). Based on the terms of the CAFO, the facility is required to pay a penalty of $17,500 and certify that SMS has taken the necessary steps to return to compliance with the RCRA violations documented in the ESA. Those ESA violations include failure to: 1) Make an accurate waste determination; 2) Maintain a less than 55-gallons of Hazardous Waste; 3) Close a Hazardous Waste Container; 4) Label and Date Hazardous Waste Containers; 5) Store Hazardous Waste for less than 90-days; 6) Receive an EPA Identification Number; 7) File a Biennial Report; and 7) Maintain Emergency Equipment.
