Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)

The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. ?? 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Syngenta Crop Protection, LLC (hereinafter Syngenta), pursuant to Section 9(c)(3) of FIFRA, 7 U.S.C. ? 136g(c)(3) which provides the EPA with the authority to issue a NOW. As explained below, the EPA finds that Syngenta violated FIFRA Section 12(a)(1)(E) by distributing or selling misbranded pesticides.
On or around November 21, 2025, BDP International, Inc., the licensed customs broker for Syngenta, filed for entry using the U. S. Customs and Border Protection (CBP) Automated Commercial Environment (ACE) Data Processing System for the importation of the pesticide product, Aspergillus flavus NRRL 21882 (EPA registration number 100-1468), under entry number 916-54954071. The shipment arrived at the Port of Atlanta, Georgia (Port Code 1704) on or around November 23, 2025. The entry included 20 bags of the pesticide product above, each weighing 20 kilograms, for a total of 400 kilograms.
