Summary

An administrative cost-recovery settlement under Section 122(h) of CERCLA (EPA Docket No. CERCLA-03-2026-0029CR) became effective on February 18, 2026, following a 30-day public-comment period. EPA did not receive any comments on the settlement. Under the settlement, a potentially responsible party, Altuglas LLC, is required to pay EPA $30,535.39 by April 6, 2026, to settle the U.S. government's claims for its costs of removal action at the Trinseo Polymer Release Site in and near Bristol, Bucks County, PA. The settlement, which represents a 100% recovery of EPA's demand, was signed by SEMD Director, Paul Leonard, on December 18, 2025. The current settlement will compensate EPA for costs it for an emergency removal site assessment and inspection in response to the accidental release of approximately 65,000 pounds (or 8,100 gallons) of acrylic polymer emulsion into Mill Creek and the Delaware River from Altuglas's Bristol, PA facility. At the request of the Pennsylvania DEP, EPA's response activities focused on sampling in the Delaware River near several drinking-water intakes upstream and downstream of the facility, including the City of Philadelphia's Samuel S. Baxter Water Treatment Plant. EPA, DEP, and the U.S. Coast Guard (USCG) coordinated to plan sampling activities. The spill was in USCG jurisdiction, and the USCG was the lead Federal On-Scene Coordinator for this incident.
