On February 24, 2026, EPA Region 1's Regional Judicial Officer ratified an Expedited Settlement Agreement ( ESA ) with Kettle Cuisine, LLC, thereby resolving violations of the Clean Air Act's Risk Management Program ( RMP ), promulgated pursuant to Section 112(r) of the Act, at the company's plant in Lynn, MA. Kettle Cuisine manufactures refrigerated and frozen soups, sauces, broths, and other types of prepared meals using steam kettles and pouch, cup and tray fillers, a 20-foot-tall spiral hydro chiller, and a 115-foot-long immersion chiller to cool packaged products. The company failed to properly label piping and label alarms as to their use. Ammonia relief piping on the roof was located to close to the air intake for the ammonia machinery room. Ammonia piping on the roof and AMR had damaged insulation, and several ammonia evaporators were not protected from damage from lift trucks. The ESA requires compliance and payment of total penalties of $13,800. Massachusetts is not delegated to implement this program.
