Fast Power Trade Inc. (Respondent) imported 50 mini motorcycles (with nonroad spark-ignition engines) in violation of Sections 203(a)(1) and 213(d) of the Clean Air Act (CAA), 42 U.S.C. ?? 7522(a)(1) and 7547(d), and the regulations codified at 40 C.F.R. 1068.101(a)(1) and (b)(5), which collectively prohibit the importation of engines or equipment containing these engines, unless they are covered by valid EPA certificates of conformity (COCs) or are properly exempted or excluded from coverage under Title II of the CAA and its implementing regulations. EPA has found no evidence that the 50 mini motorcycles are covered by valid COCs or are exempt or excluded from coverage. Accordingly, by importing the above-referenced engines, Respondent committed 50 violations of CAA Section 203(a)(1) and 213(d)(1), 42 U.S.C. ??7522(a)(1) and 7547(d), and the regulations codified at 40 C.F.R. 1068.101(a)(1) and (b)(5).
