EPA Region 9?s Consent Agreement and Final Order (CAA-09-2026-0011) against the County of Sacramento?s Kiefer Landfill is an administrative penalty action under Clean Air Act section 113(d) addressing alleged violations of the MSW Landfill NESHAP, 40 CFR part 63, subpart AAAA (including operational and collection requirements such as 40 CFR 63.1958, 63.1959(b)(2)(ii)(B)(2)-(3), 63.1958(b), 63.1957(a), 63.1955(c), and 63.1960(e)) and Title V permit requirements enforceable under CAA section 502(a), 42 U.S.C. 7661a(a) , for the period January 24 to September 12, 2023 ; the Final Order requires payment of a civil administrative penalty of 196,936 dollars within 30 days of the filing of the Final Order , plus a stipulated penalty of 1,000 dollars per day for late payment , and authorizes interest from the filing date, a 10 percent quarterly late-payment penalty, and additional charges and collection actions under 42 U.S.C. 7413(d)(5), 31 U.S.C. 3717, 31 CFR 901.9, and 40 CFR 13.11 , with EPA able to seek judicial enforcement to recover any unpaid balance under 42 U.S.C. 7413(d)(5) .
