On March 16, 2026, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) to XTO Energy Inc. (XTO) for its oil and gas production facilities in the Texas and New Mexico Permian Basin. The CAFO addresses unauthorized emissions from flares, tanks, and other equipment identified using optical gas imaging (OGI) technology during helicopter flyovers conducted by an EPA contractor from August 25 through October 15, 2020, and from July 12 through August 15, 2022. The CAFO requires that the facility satisfy an injunctive relief package that includes permitting and operational reviews, site inspections, engineering assessment, monthly OGI surveys, and installation of tank pressure monitors, combustion control device pilot monitors, and vapor recovery unit uptime monitors. EPA agreed to allow XTO to shut-in two (2) facilities in lieu of the terms above, per their request. XTO shall send a letter to EPA detailing the work completed within one (1) year from the effective date of the CAFO. XTO also must pay a civil penalty of $778,000 within 30 days.
