The importer, Philps Consumer Lifestyle North America, attempted to import the misbranded pesticide
devices, Philips Avent Bottle Sterilizer, Philips Avent 2-in-1 Warmer and Sterilizer, and Philips
Avent Baby Bottle Sterilizer and Dryer? into the United States. All pesticide devices are required to be
labeled in accordance with, 40 C.F.R. Part 156, and cannot bear false and misleading statements (FIFRA
Section 2(q)(A)(1) and 40 C.F.R. ? 156.10(a)(5)). The distribution of a misbranded pesticide device is an
unlawful act under FIFRA Section 12(a)(1)(F), 7 U.S.C. 136j(a)(1)(F).
