On February 5, 2026, Region 1 filed an administrative settlement agreement with Nitto Denko Avecia, Inc., a pharmaceutical, preparation, manufacturing company headquartered in Milford, Massachusetts over alleged violations of the Resource Conservation and Recovery Act (RCRA). As part of the settlement, Nitto Denko Avecia, Inc. will pay a fine of $858,889 and certify compliance with RCRA. The Consent Agreement and Final Order alleges that Nitto Denko Avecia, Inc. committed two (2) counts of violations of EPA federal RCRA air emission regulations and six (6) counts of violations of the federally-authorized Massachusetts hazardous waste regulations. The most significant violations involve the failure to comply with hazardous waste storage tank standards and the failure to implement required programs to comply with the hazardous waste organic air emission standards (RCRA Subparts BB and CC) at the company?s two Milford facilities. The Commonwealth of Massachusetts is supportive of this action.
