Between November 2023 and January 2024, Respondent, using earth moving equipment, placed concrete blocks, moved gravel, and installed in-stream fencing in an effort the halt cutbank erosion on his property, impacting the bottom elevation of the Creek. This work was performed without first obtaining an CWA 404 permit. Approximately 957 feet of Saline Creek were impacted.
