Summary

On April 28, 2026, Region 1 filed a Consent Agreement and Final Order ( CAFO ) resolving alleged violations of the Clean Water Act and the Oil Pollution Prevention regulations by Shoreline Marine Terminal, LLC in New Bedford, Massachusetts. Region 1 alleged that Respondent violated requirements of the Construction General Permit during its redevelopment of a ship maintenance and repair facility. Respondent failed to implement best management practices to prevent stormwater discharges directly from the construction site into the Acushnet River and failed to conduct required site inspections. Region 1 also alleged that Respondent violated the Oil Pollution and Prevention Regulations by failing to have adequate secondary containment to prevent the discharge of oil from oil storage containers in a maintenance garage. In addition, Respondent failed to develop, maintain, and implement a Spill Prevention, Control, and Countermeasure Plan. To resolve this matter, Respondent will pay a penalty of $31,098, an amount that reflected Respondent's ability to pay. The state of Massachusetts has been notified and is supportive of this action.
