BRT failed to obtain a construction and operating permit prior to the construction and operation of new equipment at its Facility. BRT also failed to perform daily moisture content sampling and analysis for its petroleum coke. Of the data available, BRT failed to meet minimum moisture content requirements, which consequently led to BRT failing to meet monthly and annual particulate matter emissions limits. BRT has achieved compliance with the allegations in the NOV and there is no concurrent ACO in this matter.
