LODGING OF A JUDICIAL CONSENT DECREE PROVIDING FOR THE PERFORMANCE, BY APPROXIMATELY 120 PRIVATE PARTIES, OF REMEDIAL DESIGN AND REMEDIAL ACTION (RD/RA) FOR THE SECOND OPERABLE UNIT AT THE LONE PINE SUPERFUND SITE IN FREEHOLD TOWNSHIP, NEW JERSEY. THE CONSENT DECREE ALSO PROVIDES FOR REIMBURSEMENT BY THE SETTLORS IN PAST RESPONSE COSTS INCURRED BY THE UNITED STATES PAST STATE RESPONSE COSTS. THE SETTLORS ALSO AGREE TO PAY FUTURE STATE AND FEDERAL OVERSIGHT COSTS ASSOCIATED WITH THE SECOND OPERABLE UNIT. WITH THE SETTLEMENT FOR PERFORMANCE OF THE SELECTED REMEDY FOR THE FIRST OPERABLE UNIT, CONSISTING OF A LANDFILL CONTAINMENT SYSTEM, REACHED IN U.S. V. ACTON (ENTERED 3/5/90) AND THE SETTLEMENT IN PRINCIPLE FOR PAYMENT IN CARVED OUT OPERABLE UNIT ONE COSTS REACHED IN U.S. V. ARMSTRONG LITIGATION, THE GOV'T WILL HAVE RECOVERED OVER 99% OF ITS PAST AND PROJECTED COSTS ASSOCIATED WITH THE SITE.
