RESPONDENT WAS IN VIOLATION OF SECTION 409 OF TSCA BY: 1) FAILURE TO PERMIT THE RISK ASSESSMENT; 2) FAILURE TO AT- TACH A STATEMENT BY THE PURCHASER INDICATING THAT THE PURCHASER HAS EITHER RECEIVED THE OPPORTUNITY TO CONDUCT A RISK ASSESSMENT OR WAIVED SUCH AN OPPORTUNITY; 3) FAIL- URE TO INCLUDE AS AN ATTACHMENT, A LIST OF OF ANY RE- CORDS OR REPORTS, AVAILABLE TO THE SELLER REGARDING LEAD- BASED PAINT AND/OR LEAD-BASED PAINT HAZARDS IN THE TARGET HOUSING, OR A STATEMENT THAT NO SUCH RECORDS EXIST; AND 4) FAILURE TO INCLUDE THE SIGNATURES CERTIFYING TO THE ACCURACY OF THEIR STATEMENTS AS WELL AS DATES. 4.
