THE FACILITY IS A ONE STORY OFFICE BUILDING WHICH IS OCCUPIED BY LYON AND ASSOCIATES REALTORS. THE ROOF OF THIS BUILDING WAS COVERED WITH A FRIABLE ASBESTOS FELT MATERIAL UNDER WOODEN SHINGLES. THE FELT ROOFING MATERIAL CONTAINING ASBESTOS WAS REMOVED WITHOUT NOTICE TO EPA AND IN VIOLATION OF THE WORK PRACTICE PROCEDURES SET FORTH IN 40 C.F.R. PART 61, SUBPART M. REGION 9 PLANS TO RESOLVE THIS CASE VIA CONSENT DECREE THAT WILL CALL FOR A PENALTY IN THE RANGE OF $64,500. THE SACRAMENTO AIR POLLUTION CONTROL DISTRICT HAS HAD NUMEROUS CONTACTS WITH ALL OF THE DEFENDANTS WHILE ATTEMPTING TO SETTLE THEIR ASBESTOS ENFORCEMENT CASE. ALSO, EPA HAS HAD LIMITED CONTACT WITH THE ATTORNEY FOR DEFENDANT LYON AND ASSOCIATES REALTORS, URGING THAT THE COMPANY HIRE AN ASBESTOS CONTRACTOR TO REMOVE ANY REMAINING DEBRIS.
