This proposed order and penalty complaint with notice of opportunity for hearing is issued to Cornell Fertilizer for failure to close or retrofit the Class V disposal system in a manner that would keep contaminants from entering a USDW, and for failure to submit a written schedule for retrofitting the facility and/or plugging the drains(s) and an alternative disposal plan for its waste fluids.
