Summary

This is a resolution of a voluntary disclosure by means of an administrative penalty action issued to La Paloma Generating Company, LLC (Respondent) pursuant to the CAA. The violation involves failure to sumit a risk management plan for Respondent's electric power generating plant in McKittrick, California that uses aqueous ammonia in its selective catalytic reduction system to reduce emissions of nitrous oxide. During an environmental audit of its operations, Respondent discovered a violation of CAA Section 112(r)(7), and promptly disclosed the violation to EPA. This enforcement action based on the voluntary self-disclosure by Respondent is being used to resolve the violations pursuant to 40 CFR Sections 22.13 and 22.18.
