THIS CASE IS ABOUT TWO CONSTRUCTION SITES KNOWN AND CONDADO HOTEL DUO WHICH CONSIST OF THE CONSTRUCTION AND REMODELIN OF LA CONCHA HOTEL AND VANDERBILT HOTEL.
The inspected the sites on April 2006, August 2006 and September 2006. The results of the inspections revealed that construction activities were causing discharges of contaminated groundwater (high levels of turbidy and fecal coliforms) in violation of its NPDES general permit for construction activities.
The compliance order requested Respondents to cease and desist the storm water and contaminated groundwater discharges and to cease earth movement activities. The order also required Respondents to submit a compliance plan by November 11, 2006, to bring the construction sites into compliance with the construction general permit.
IT IS BEING REPORTED STORM WATER POLLUTANT REDUCTION IN GALLONS. HOWEVER, THE REAL POLLUTANT LOADINGS ARE THE REDUCTION OF TURBIDITY LEVELS FROM 60 NTU TO LESS THAN 10 NTU, AND THE REDUCTION OF FECAL COLIFORMS FROM AN AVERAGE OF 8,000 COLONIES/100 ML TO LESS THAN 200 COLONIES/100 ML. ALSO, A REDUCTION OF STORM WATER/GROUNDWATER DISCHARGES WAS ACHIEVED FROM 600,000 GPD TO ZERO DISCHARGE.
