This is an Administrative Penalty action issued to Cal-Chem Metals, Inc. (Respondent) pursuant to both EPCRA 312 and EPCRA 313. The violation involves failure to report to EPA under EPCRA Section 313 on chemical usage and storage and failure to report as required under EPCRA Section 312 to the State Emergency Response Commission (SERC) and the Local Emergency Planning Committee (LEPC). This matter was referred to EPA for investigaiton by the SERC following two fires at the facility which resulted from improper handling of chemicals. The Complaint seeks a penalty in the amount of $52,203.
