The Defendant is a secondary lead smelting facility that failed to submit notifications or to operate according to SOP manuals. The Defendant further failed to conduct the initial performance testing or the subsequent testing and failed to maintain records and submit records in accordance with regulations.
Under the CD, the Defendant will pay a civil penalty. Defendant also required to implement a more effective environmental program for tracking monitoring compliance, and submission of records and reports as required by the Secondary Lead MACT. Additionally, the facility was required to conduct a performance test and must demonstrate compliance.
