EPA has determined the proposed penalty of $157,500 against the Puerto Rico Aqueduct and Sewer Authority concerning the Baldorioty de Castro Wastewater Collection System (WWCS, an appurtenance of the Puerto Nuevo Regional Wastewater Treatment Plant). The violations taking into account in the complaint are: the failure to provide proper Operation and Maintenance (O&M) to the Baldorioty de Castro WWCS, the unlawful discharges of untreated sewage (wastewater) and not reporting instances of non-compliance, in violation of the facilityÂs National Pollutant Discharge Eliminations System (ÂNPDESÂ) Permit (PR0021555) and Section 301(a) of the Act, 33 U.S.C. §1311. The violations taken in the Complaint occurred within the period of January 2003 to December 2005 .
