## Summary

U.S. Environmental Protection Agency (U.S. EPA) Region 5 issued a Finding of Violation (FOV) on March 31, 2003 to A. Finkl & Sons for its facility located at 2011 North Southport Avenue, Chicago, Illinois.  The FOV was issued for non-compliance with New Source Performance Standards (NSPS) for Electric Arc Furnaces, Subpart AAa.  U.S. EPA alleges that A. Finkl replaced the transformers associated with its two furnaces, thereby increasing emissions and triggering applicability of the NSPS.  Subsequently, A. Finkl enclosed the building that houses the furnaces and installed a new dust collector to better capture particulate emissions.  U.S. EPA Region 5 and A. Finkl signed a Consent Decree requiring A. Finkl to comply with the NSPS, which limits opacity and requires testing, reporting, and monitoring of the furnaces' operation. A. Finkl will pay a cash penalty of $75,000. In addition, A. Finkl will perform two Supplemental Environmental Projects at a cost of $620,000. The first project will install low NOx-generating burners in one of the plant's furnaces, and the second will provide for the installation of oxidation catalysts on municipal vehicles such as garbage trucks owned by the City of Chicago to reduce emissions of volatile organic compounds, particulate, and carbon monoxide.
