This is a Civil Judicial Action pursuant to Section 111 of the Clean Air Act, 42 U.S.C. ?? 701 et seq. asking the Department of Justice to bring an action against Waste Management of Hawaii, Inc. (WMH) and the City and County of Honolulu (CCH). The violation involves control of Non-Methane Organic Compounds (NMOC). WMH and CCH violated the New Source Performance Standards (NSPS) regulations by failing to timely submit a design plan to EPA (due in 2001, submitted in 2005) regarding the building of a Gas Control and Collection System (GCCS), award contracts for the Gas Control and Collection System (due in 2001, awarded in 2002), begin GCCS construction (due in 2002, begun in 2005), complete GCCS construction (due in 2002, completed in 2005), and submit notifications to EPA regarding failures to complete the above four increments of progress.
