An EPA inspection conducted on October 20, 2006, found the Respondents tank battery facility to be in violation of the CWA. The violation consists of an unauthorized point source discharge of a pollutant, specifically produced fluids, to waters of the US. The impacted water body was identified as a tributary of Little Dry Creek.
A Cease and Desist Administrative Order is being issued to the Respondent to immediately cease all discharges of pollutants from the facility.
