This is an Administrative Consent Order (AOC) pursuant to CERCLA 122(h) to recover removal costs incurred by EPA at the South Bay Asbestos Superfund Site from the City of San Jose. The response action for which these costs were incurred concerned removal of asbestos contamination from an Environmental Education Center (EEC) within the Site. The AOC recovers $245,290.70 in EPA costs for the removal while providing the City a covenant not to sue for past costs incurred by EPA at the EEC.
