Failure to submit in a timely manner a Form R for otherwise using greater than 10000 pounds of ammonia for calendar year 2002. The due date for 2002 was July 1, 2003; the Form R report was over a year late. This case was referred by ERRD to DECA. The failure to submit a Form A or R report, in a timely manner, constitutes a violation of Section 313 of the Emergency Planning and Community Right-to-Know-Act, 42 U.S.C. § 11023, and with 40 C.F.R. § 372.30. This is a combined administrative civil complaint and consent agreement final order action with a penalty of $3,300.
