As a followup to a citizen complaint, a storm water compliance inspection was conducted October 11, 2006, at the construction site of the Osage Million Dollar Elm Casino, Bartlesville, OK. The site had approximately 10 acres disturbed at the time of the inspection with approximately 38 acres to be disturbed before the project was completed. Construction activities began approximately April 15, 2006, and was scheduled to commence in February 2007. As an operator, TDC Oklahoma had not applied for permit coverage with EPA at the time of the inspection. The SWPPP was inadequate and did not meet all the requirements of the permit. Because TDC Oklahoma met the criteria of the Expedited Settlement Offer, one was extended. If the offer is accepted, the action will be executed, TDC will certify all deficiencies have been corrected and will pay the assessed penalties.
