## Summary

On March 12, 2008, the United States entered a Consent Decree in U.S. District Court for the District of Idaho in connection with the United States v. Tamarack Resort LLC case.  Tamarack is a large ski resort and golf course complex under construction in rural Idaho north of Boise.  This enforcement action arose out of a series of storm water compliance inspections by EPA and Idaho Department of Environmental Quality of the Tamarack construction site that began in 2005.  In its Complaint, which was filed along with the lodged Consent Decree on January 24, 2008, the United States alleges that Tamarack discharged sediment to the Cascade Reservoir and failed to comply with the terms of its NPDES storm water permit.  The terms of the settlement require Tamarack to pay a penalty of $185,000 and to curtail its winter construction practices to avoid further discharges of sediment to Cascade Reservoir.
