On December 12, 2006, Respondent imported into the Port of Savannah, Georgia forty-eight off-highway motorcycles. U.S Customs inspected the entry and determined that the motorcycles bore EPA emissions labels that could be peeled-off without destroying or defacing label, and the label did not state the month and year of manufacturer of the motorcycle, in violation of 40 C.F.R. 1051.135(a)(1) and (a)(6), respectively. In addition, to paying a civil penalty of $5,000, Respondent is required to export the motorcycles.
