On November 22, 2021, DOJ, on behalf of EPA Region 3 and VaDEQ, lodged a proposed fifth amendment to the 2010 consent decree with Hampton Roads Sanitation District (HRSD). Under the modification, HRSD has agreed to implement a comprehensive set of projects and improvements to the sewer system to resolve longstanding problems with sanitary sewer overflows throughout the HSCD service area, which includes 18 municipalities with 1.7 million residents. The projects will help protect water quality in the Chesapeake Bay Watershed. The modification to the Consent Decree is subject to a 30-day public comment period and approval by the federal court.
