On November 17, 2006, Southwest Research Institute (SWRI) collected a sample of diesel fuel that was dispensed from a a fuel pump stand that was not labeled as either ultra-low sulfur diesel fuel or as low sulfur diesel fuel at the Propst Superette retail station. SWRI subsequently analyzed the fuel sample and determined that its sulfur content was 65 ppm. Respondent violated 40 CFR 80.570, 80.520(c), and 80.610(a) by failing to prominently and conspicuously label the pump stand as Low Sulfur Highway Diesel Fuel. In addition to correcting the violation, Respondent was required to pay a civil penalty of $500.
