Respondent failed to comply with the requirements of 40 CFR Section 745.113(b)(2) and (b)(3)in leasing 4 units of a 39-unit apartment building built in 1935. Children were present in 3 of the 4 unites cited.
Windows in the building have been replaced, and testing conducted (at a cost of $3,425) after the complaint was issued it was determined that two units were lead-based paint free and the remainder of the residential units and common areas were lead-based paint hazard free.
