Gloucester Point, Inc. hired Phil Franchi Demolition & Excavating, Inc. (Franchi) to demolish the Old GAF Facility, located in Gloucester City, New Jersey, which contained regulated asbestos-containing material (RACM). Franchi failed to submit the 10-day notification, remove all RACM prior to demolition, maintain the RACM wet until disposal, and seal the RACM in leak tight containers, in accordance with the asbestos NESHAP regulations. Penalty to be split between both defendents. Gloucester will pay $6000 and Franchi will pay $24000, both on quarterly payment schedules for a year.
