Scott Brass failed to apply for a Part 70 permit required by the Indiana Administrative Code (326 IAC 2-7). The settlement requires that Scott Brass apply to the Indiana Department of Environmental Management for a Part 70 permit. Scott Brass was not required to conduct any additional recordkeeping, reporting or testing requirements after the Finding of Violation.
